Tech Trend Trader (the Services) is published by Weiss Group, LLC (Weiss Group) with the following terms and conditions (“Terms”):
Weiss Group is a publisher. Weiss Group is strictly a financial research publishing firm (a publisher) and does not provide individual investment advice to its subscribers. Weiss Group is not an investment adviser, money manager or a registered securities broker/dealer.
Automatic renewal. Unless you are a member of our lifetime membership service, your subscription will continue for the initial term of the subscription (the “Initial Term”). We will notify you ahead of time when it is coming up for renewal. We will give you the opportunity to respond. And unless you tell us not to, we will renew automatically at the end of the Initial Term. The automatic renewal program provides for the following:
As a convenience to its users, Weiss Group subscribes to a third party service wherein if your payment details change your credit card provider may provide updated card information. We may use this new information for your future subscription payments ("Account Updater").
Refund policy. Your first-year membership fee is not refundable. However, you have two options:
Your second and subsequent year membership fees are refundable as described above.
Gains and results. Gains on individual stocks are based on published articles that profiled and recommended those stocks just before they rose by the amounts cited.
The ability to use ETFs to turn $40,000 into $2.2 million is based on historical data with the following assumptions: (1) a starting investment of $40,000 in June of 2010, (2) following the DISRUPT 3.0 strategy recommendations, (3) paying stock commissions and fees plus any applicable taxes from a separate account, (4) continuing to follow the strategy until April of 2019. (An updated study of the strategy through August 28, 2019 reveals continued outperformance.)
Investors should recognize that backtesting based on historical data has limitations. For example, it does not include transaction fees. It does not account for the fact that investors don’t always get the prices they expect. Nor is it our intention to follow the model blindly. We will make needed adjustments to adapt to market conditions.
Our backtesting was designed to be rigorous and fair. We feel it provides a good indication of the potential to greatly outperform the S&P in both up and down markets. However, it is not possible to completely eliminate the benefit of hindsight.
Risk. Any kind of trading is considered speculative and involves risk of loss. Although the Services makes every effort to protect your principal, you can lose money. Therefore, it is not for all of your funds. If your goal is strictly capital preservation, we believe you should invest those funds in conservative investments such as US Treasury securities or equivalent. For more information on prudent investing, see also the information available at the websites of the Securities and Exchange Commission at www.sec.gov and the Financial Industry Regulatory Authority at www.FINRA.org. Any money you allocate to speculative investments should be strictly the money you can afford to risk without jeopardizing your daily life, and without negatively impacting your plans for education, retirement, or long-term care.
Not personal. Although we make every effort to provide the most accurate and updated information possible, our information cannot take into consideration your personal finances and goals, and therefore is not intended to be used as customized recommendations to buy, hold, or sell investments, or to engage in any trading strategy, or that an investment strategy is suitable for any specific person. Such recommendations may only be made by a financial adviser or broker you select.
Our editors and staff will gladly answer your generic questions regarding the Services and our recommendations in a factual manner. However, none of the Services creators, editors, providers, contributors or their affiliates will advise you personally concerning the nature, potential, value or suitability of any particular security, portfolio of securities, transaction, investment strategy or other matter. The views expressed in the Services are the authors’ own opinions, which may differ from those expressed by other authors or in other Weiss Group services.
Data sources. Most of the information we publish is derived from primary sources, including the publicly traded companies we cover and government sources. We believe our data sources are accurate, but we do not verify their accuracy independently. Therefore, we cannot assure that the information is always accurate or complete. Profit illustrations. Examples of potential performance returns which we cite may sometimes be based on simulated — not actual — trades, assuming entry and exit prices that could have been obtained during regular market conditions. Privacy Protection and Opt-In Policy. We do not contact subscribers or followers unless requested to do so by those individuals requiring or requesting further information from us. Member contact information is used to send information about our company and promotional materials sent from Weiss Group. Registration and Privacy. The performance experienced by a subscriber as described in user comments and/or testimonials in any of our promotional advertising or on our website is not necessarily reflective of what you should expect to experience. You agree that your use of the Services is at your sole risk and acknowledge that the Services and anything contained therein, including, but not limited to, content, services, goods or advertisements (the "Items") are provided "AS IS" and that Weiss Group makes no warranty of any kind, express or implied, as to the Items, including, but not limited to, merchantability, noninfringement, title or fitness for a particular purpose or use. Weiss Group does not warrant that the Services is compatible with your equipment or that the Services are free of errors or viruses and is not liable for any damage you may suffer as a result of such destructive features. You agree that Weiss Group, its Suppliers and its third-party agents shall have no responsibility or liability for any injury or damages, whether caused by the negligence of Weiss Group, its employees, subcontractors, agents, suppliers or otherwise arising in connection with the Services and shall not be liable for any lost profits, losses, punitive, incidental or consequential damages or any claim against Weiss Group by any other party or any fault, inaccuracy, omission, delay or any other failure in the Services caused by your computer equipment or arising from your use of the Services on such equipment.
The content of other Web sites, services, resources, goods or advertisements (including those for which Weiss Group may receive compensation) that may be linked to the Services is not maintained or controlled by Weiss Group. Weiss Group is therefore not responsible for the availability, content or accuracy of other Web sites, services, resources or goods that may be linked to, or advertised on, the Services. Weiss Group does not make any warranty, express or implied, with respect to the use of the links provided on the Services, guarantee the accuracy, completeness, usefulness or adequacy of any other Web sites, services, resources, goods or advertisements that may be linked to the Services or make any endorsement, express or implied, of any other Web sites, services, resources, goods or advertisements that may be linked to the Services. Weiss Group is also not responsible for the reliability or continued availability of the telephone lines and equipment you use to access the Services. You understand that Weiss Group and/or third-party contributors to the Services may choose at any time to inhibit or prohibit their content from being accessed under the Terms. You acknowledge that the Services are provided for information purposes only and are not intended for trading purposes. Weiss Group does not guarantee the sequence, accuracy, completeness or timeliness of the Services and the provision of certain parts of the Services is subject to the terms and conditions of other agreements to which Weiss Group is a party. Accordingly, anything to the contrary herein set forth notwithstanding, Weiss Group, its officers and employees, partners, affiliates, subsidiaries, successors and assigns, suppliers and its third-party agents shall not, directly or indirectly, be liable, in any way, to you or any other person for any inaccuracies or errors in or omissions from the Services including, but not limited to, quotes and financial data, abstracts, delays, errors or interruptions in the transmission or delivery of the Services or any loss or damage arising therefrom or occasioned thereby, or by any reason of nonperformance.
Limitation of Liability. UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL WEISS GROUP, ITS SUPPLIERS AND ITS THIRD PARTY AGENTS BE LIABLE TO YOU FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES EVEN IF A WEISS GROUP AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED SPECIFICALLY OF THE POSSIBILITY OF SUCH DAMAGES, ARISING FROM USE OF OR INABILITY TO USE the Services OR ANY PROVISION OF THE TERMS, SUCH AS, BUT NOT LIMITED TO, LOSS OF REVENUE OR ANTICIPATED PROFITS OR LOST BUSINESS. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages. In no event shall Weiss Group total liability to you for all damages, losses, and causes and action (whether in contract or tort, including but not limited to negligence) exceed the amount paid by you, if any, for accessing the Services.
Indemnification. You agree, at your own expense, to indemnify, defend, and hold harmless Weiss Group, and its employees, representatives, suppliers, and agents, against any claim, suit, action, or other proceeding brought against Weiss Group, its employees, representatives, suppliers, and agents, by a third party, to the extent that such claim, suit, action or other proceeding brought against Weiss Group, its employees, representatives, suppliers, and agents is based on or arises in connection with the Services, including but not limited to your use or someone using your computer's use of the Services; a violation of the terms by you or anyone using your computer; a claim that any use of the Services by you or someone using your computer infringes any Intellectual Property Right (as herein defined) of any third party, or any right of personality or publicity, is libelous or defamatory, or otherwise results in injury or damage to any third party; any deletions, additions, insertions, or alterations to, or any unauthorized use of, the Services by you or someone using your computer; any misrepresentation or breach of representation or warranty made by you contained herein; or any breach of any covenant or agreement to be performed by you hereunder. You agree to pay any and all costs, damages, and expenses, including, but not limited to, reasonable attorneys' fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit, action or proceeding attributable to any such claim.
Termination of Terms. Either you or Weiss Group may terminate the Terms at will, at any time and effective immediately. You may terminate the Terms by discontinuing use of the Services and destroying all materials obtained from the Services. These Terms will terminate immediately without notice from Weiss Group if you, in Weiss Group’s sole discretion, fail to comply with any provision of these Terms. Upon termination by you or upon notice of termination by Weiss Group, you must destroy promptly all materials obtained from the Services and any copies thereof.
Governing law. This Agreement shall be governed and construed in accordance with the laws of the United States and the State of Florida, without giving effect to conflicts of law principles thereof. You agree to submit to the personal jurisdiction of the state and federal courts located in Palm Beach County in the State of Florida with respect to any legal proceedings that may arise in connection with the Services or from a dispute as to the interpretation or breach of the terms of service.
Accessing Services Outside the United States: Weiss Group does not represent that materials in the Services are appropriate or available for use in countries outside the United States. If you choose to access the Services from outside the United States, you are responsible for compliance with foreign and local laws. Software is further subject to United States export controls and may not be downloaded, exported, or reexported into (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, or Syria, Sudan, or any other country to which the U.S. has embargoed goods or to anyone on the U.S. Treasury Department's Table of Deny Orders.
